By accessing or purchasing from HIMOD, you agree to be bound by these Terms of Service, including all linked policies such as our Return & Exchange Policy, Privacy Policy, Shipping Policy, and Warranty Policy. If you do not agree, you may not use our website, purchase products, or access any services from HIMOD.
1. General
- HIMOD is not affiliated with, endorsed by, or connected to Toyota or any other car company whose logos or products appear on our website, social media, or packaging.
- Products displayed are non-genuine aftermarket parts; some are intended for off-road use only.
- Users assume all risk for performance, installation, or misuse.
- HIMOD is not responsible for bodily injury or mechanical damage resulting from use or installation.
2. Statutory Consumer Rights (ACCC Disclaimer)
- These Terms do not limit your statutory rights under Australian Consumer Law.
- Customers are entitled to a repair, replacement, or refund for faulty, damaged, or misdescribed products.
- Our store credit / return policy applies only to change-of-mind or non-defective returns.
3. Orders and Contract of Sale
- All orders are final once placed. No cancellations are allowed after the order is submitted.
- By completing a purchase, you enter a binding contract of sale with HIMOD.
- Any disputes, changes, or cancellations outside of approved exchanges or returns will not be accepted.
4. Returns & Exchanges
- Our Returns & Exchanges Policy applies.
- Change-of-mind returns are eligible for store credit only, within 30 days of delivery, with applicable fees.
- Exchanges are allowed per policy, with shipping and restocking fees applied as outlined.
- For defective items or warranty claims, refer to our Warranty Policy.
5. Pricing and Changes
- All prices are in AUD and are subject to change without notice.
- HIMOD reserves the right to alter product availability, pricing, or specifications at any time.
- Orders placed at incorrect pricing may be cancelled or adjusted at HIMOD’s discretion.
6. Payment
- Orders will only be processed once payment is received in full.
- HIMOD reserves the right to withhold goods if payment is disputed, withheld, or subject to a chargeback.
- High-risk or medium-risk orders may be cancelled automatically. Customers may reorder via PayPal if desired.
7. User Responsibilities
- Customers must comply with all laws, regulations, and HIMOD policies when using products.
- Users may not reproduce, duplicate, sell, or exploit any content from the website without express permission.
- Providing false, misleading, or abusive information may result in banning or refusal of service.
8. Content and Reviews
- HIMOD reserves the right to remove false, misleading, or defamatory reviews/comments from any platform we operate.
- Reviews or comments from users with no verified purchase history may be removed at our discretion.
9. Product Compatibility
- HIMOD provides compatibility information where possible.
- Users assume responsibility for verifying product fitment.
- If a product is not compatible and warnings were clearly provided, no refunds will be issued.
10. Warranty and Defective Products
- For defective items, contact HIMOD within 5 days of delivery.
- HIMOD may provide a replacement, store credit, or return label at our discretion.
- Warranty coverage is governed by our Warranty Policy, which works in conjunction with ACCC statutory rights.
11. ADR Compliance / Legal Use of Products
- Some products sold by HIMOD, including tail lights, LED bars, and other automotive components, may not comply with Australian Design Rules (ADR) for on-road use.
- Customers are responsible for ensuring that any product purchased is legal for use on public roads in their state or territory.
- HIMOD does not guarantee ADR compliance and is not responsible for fines, penalties, or legal issues arising from use of non-compliant products.
- Products may be intended for off-road use only; using them on public roads may void vehicle insurance or breach traffic regulations.
- By purchasing these products, customers acknowledge and accept all legal risks.
12. Liability
- HIMOD is not responsible for any loss, injury, or damage resulting from use or installation of products.
- We make no guarantees that our service, website, or online store will be uninterrupted, secure, or error-free.
